Terms of Service.

Effective November 1, 2026oysterme LLC

The rules for using oysterme, written to be read. The short version is below. The full terms follow.

The short version

  • You must be 18 or older, and your profile has to be you.
  • You own your content. We only use it to run oysterme for you.
  • Be respectful. Hurtful messages are blocked: one warning, then you're banned. Threats are an instant ban.
  • oysterme never sends messages for you. Texts come from your own phone.
  • We don't run background checks and we don't vouch for anyone. Meet in public.
  • Band sales are final once activated. Subscriptions renew until you cancel, and cancelling takes one tap.

01Agreeing to these terms

These Terms are an agreement between you and oysterme LLC ("oysterme," "we," "us"). They cover oysterme.co and its subdomains, app.oysterme.co, profile pages and links, oysterme bands, cards and phone tags, and oysterme+ subscriptions (together, the "service"). By creating an account, buying a band, or using the service, you agree to these Terms, our Privacy Policy, our Community Guidelines and, for purchases, our Refund Policy. If you don't agree, please don't use oysterme.

02Who can use oysterme

  • You must be at least 18 years old. We ask for your date of birth, and we close accounts that belong to anyone younger.
  • You can't use oysterme if we've banned you before, or if the law doesn't allow you to.
  • One account per person. Your profile has to be about you, not someone else.
  • You must be single or otherwise free to date in order to use Dating mode. We can't check this, but misrepresenting it is a breach of these Terms.

03Your account

We sign you in with a one-time code sent to your email, or with Facebook if you choose. Keep access to that email or Facebook account secure, because anyone who can use it can sign in as you. You're responsible for what happens on your account. Tell us right away at privacy@oysterme.co if you think someone else has used it.

04Your profile and content

You own what you put on oysterme: your photos, voice note, bio, prompts, answers, notes and resume ("your content"). You give us a worldwide, royalty-free license to host, store, display, reproduce and process your content to run oysterme for you, to show your pages to the people you share them with, and to keep the service safe. The license ends when you delete the content or your account, except for copies in backups that roll off on schedule and records we must keep by law.

You confirm that you have the right to post your content, that it's accurate, and that photos are of you. We may remove content that breaks these Terms or our Guidelines, or that we reasonably believe is illegal, infringing or harmful.

05Vouches and ex reviews

A vouch is written by someone you invite. The writer owns their words and gives us the same license above so we can show the vouch on your page. The writer can withdraw a vouch at any time. You can hide any vouch, and a review from an ex is never shown until you choose to show it.

Vouches must be written by the real person you invited, about you, in their own words. Writing your own vouch, paying for one, or inviting someone to write something false is a breach of these Terms. If you believe a vouch about you is false or harmful, hide it and report it to us.

Private ratings given by vouch writers are used only inside our systems to order vouches. They are never shown to anyone and are not a judgment by oysterme about any person.

06Community Guidelines and enforcement

Our Community Guidelines are part of these Terms. In short: no harassment, threats, hate, pressure, impersonation, spam or anything involving a minor. Messages, notes, vouches and custom questions are checked automatically before they're delivered.

  • A message that breaks the Guidelines is blocked and never delivered. The sender gets one warning.
  • A second flagged message closes the account.
  • Threats of violence, sexual content involving a minor, or anything illegal: immediate ban, no warning, and we may report it to law enforcement.

These rules apply to members and to visitors who use our links without an account. Bans follow the person, not the link. You can ask us to review a warning or ban, and a person will look at it. Our decision after review is final.

07Messages you send

oysterme never texts, calls or emails your contacts or your dates. When you send a follow-up, a vouch request or a first-date link, it opens your own Messages or email app, and you choose whether to send it. Send links only to people you actually met or matched with, never in bulk, and never to someone who asked you to stop. You're responsible for complying with the laws that apply to messages you send.

08Meeting people and safety

Please read this. oysterme does not run criminal background checks on members or visitors. A verified badge means a government ID matched a selfie; it does not mean a person is safe. We don't vouch for anyone, we don't check vouches for truth, and we're not responsible for how members or visitors behave online or in person.

You alone decide who to meet and where. Read our Safety page, meet in public, tell a friend where you'll be, arrange your own transportation, and leave if something feels off. If you feel unsafe, contact local emergency services first and report the person to us after.

Out tonight lists events and venues run by other people. We don't run them, we don't sell their tickets, and we can't promise an event will happen as described or that any particular people will be there. Verify details with the organizer. Any event we host ourselves will have its own terms shown before you register.

09After Dark

After Dark is an optional, 18+ set of bolder questions. It only opens when both players have opted in, and either player can turn it off at any time. Anything our checks flag as explicit stays covered until the receiving person chooses to see it. Everything in the Guidelines still applies: bold is allowed, hurtful is not. Don't use After Dark to pressure anyone, and stop if someone asks you to.

10Bands and other products

Your oysterme band, card or phone tag stores a link to your page. It doesn't store your personal details. You can change your page any time without touching it. Pause your page if a band is lost or stolen.

Orders are subject to our Refund Policy, which you accept at checkout. We ship within the United States. Title and risk of loss pass to you when the carrier confirms delivery. Prices, shipping and taxes are shown before you pay. We may cancel an order for suspected fraud, pricing errors or stock problems and will refund anything you paid for it.

Bands are consumer products for everyday wear. They are not medical, safety or fitness devices. Don't rely on a tap working in any situation where failure would cause harm.

11oysterme+ subscriptions

oysterme+ is a paid subscription billed monthly or yearly. Before you subscribe we show you the price, what's included, and how often you'll be charged.

  • Automatic renewal. Your subscription renews automatically at the end of each period at the then-current price until you cancel. We'll email you before an annual renewal.
  • Cancel any time in Settings, with one tap, and in no more steps than it took to sign up. Cancelling stops the next charge. You keep oysterme+ until the end of the period you paid for.
  • No partial refunds. See our Refund Policy.
  • Bands included with annual plans are a bonus with no cash value and follow the Refund Policy.
  • Price changes apply at your next renewal, and we'll tell you at least 30 days before.
  • Same price for everyone. We don't price by gender or any other protected characteristic.

12AI features

Safety checks, profile help, resume writing, conversation starters and Out tonight research use AI. AI can be wrong. Check scanned details before saving them, treat suggestions as ideas, verify events with the organizer, and tell us if a safety check blocked something it shouldn't have.

13Our service and changes

We may add, change or remove features, and the service may sometimes be unavailable. We'll try to give notice of big changes that affect you. The oysterme name, logo, band design, content and software belong to oysterme LLC. These Terms don't give you any rights to them except to use the service as intended. You may not scrape, copy, resell or reverse-engineer the service.

14Ending your account

You can stop using oysterme anytime and delete your account in Settings or by emailing privacy@oysterme.co. We may suspend or close your account if you break these Terms or the Guidelines, create risk or legal exposure for us or others, or if we discontinue the service. If we close your account for breaking the rules, you aren't entitled to a refund of any subscription fees.

15Disclaimers

oysterme is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, except the limited product replacement promise in our Refund Policy. We don't promise that the service will be uninterrupted or error-free, that taps will always work, that events will happen as listed, that vouches are true, or that any person you meet is who they say they are or is safe.

16Limits on our liability

To the fullest extent the law allows, oysterme LLC and its owners, employees and providers won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, or for the conduct of any member, visitor, event organizer or venue, arising from your use of the service. Our total liability for any claim is limited to the greater of $50 or the amount you paid us in the 12 months before the claim. Some states don't allow these limits, so some may not apply to you.

17Your responsibility to us

If someone makes a claim against us because of your content, your vouches, the messages you send, your conduct toward another person, or your breaking these Terms or the law, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.

18Governing law and disputes

These Terms are governed by the laws of the State of Ohio and applicable US federal law, without regard to conflict-of-law rules. Before filing any claim, email us at privacy@oysterme.co and give us 30 days to work it out with you. If we can't, claims must be brought in the state or federal courts located in Summit County, Ohio, and you agree to that venue, except that either side may bring an eligible claim in small-claims court.

You and oysterme agree that each may bring claims against the other only individually, and not as a plaintiff or class member in any class or representative action.

19Changes to these terms

We may update these Terms. We'll change the effective date at the top, and for significant changes we'll tell members by email or in the app before they take effect. If you keep using oysterme after that, the new Terms apply.

20Everything else

These Terms, the Privacy Policy, the Community Guidelines and the Refund Policy are the whole agreement between you and us about oysterme. If any part is found unenforceable, the rest still applies. If we don't enforce something right away, we can still enforce it later. You can't transfer your account or these Terms to anyone else. Questions: privacy@oysterme.co.
